Terms & Conditions

Please read these terms carefully before using WakaSafe. By downloading, installing, or using the application, you agree to be bound by these terms.

These Terms and Conditions ("Terms") govern your access to and use of WakaSafe, a mobile application developed and operated by Voddic LTD, a technology company incorporated in Nigeria ("Voddic", "we", "us", or "our"). WakaSafe provides offline-first emergency journey tracking services via SMS for travelers within Nigeria and beyond. By using WakaSafe, you acknowledge that you have read, understood, and agree to these Terms in full.

Acceptance of Terms

By downloading, installing, registering for, or otherwise using the WakaSafe application on any device, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use WakaSafe.

These Terms constitute a legally binding agreement between you and Voddic LTD. Your continued use of the application following any updates or modifications to these Terms constitutes your acceptance of the revised Terms.

Note: If you are using WakaSafe on behalf of an organisation or third party, you represent and warrant that you have the authority to bind that organisation to these Terms.

Description of Service

WakaSafe is an offline-first Android application that enables travelers to broadcast their real-time GPS location to designated emergency contacts via native SMS messages — without requiring an active internet connection.

The core features of WakaSafe include, but are not limited to:

  • Journey initiation by specifying origin, destination, vehicle type, plate number, and SMS update interval
  • Automated periodic SMS transmission of GPS coordinates and journey details to emergency contacts
  • A 4-digit PIN system to start and end journeys securely
  • A secret distress PIN that silently triggers an emergency SOS SMS to all registered contacts
  • Journey history log with broadcast status records
  • Subscription-based access enforced via a secured payment gateway

Voddic reserves the right to modify, suspend, or discontinue any feature of the service at any time with or without notice.

Eligibility

To use WakaSafe, you must:

  • Be at least 18 years of age. Users under 18 must have explicit parental or guardian consent
  • Own or have lawful access to a mobile device capable of running the application
  • Possess a legal and valid SIM card with an active SMS plan from any Nigerian mobile network operator (MTN, Airtel, Glo, 9mobile, or any other supported carrier)
  • Reside in or be traveling within a jurisdiction where SMS-based location sharing is lawful
  • Have the consent of all emergency contacts added to your profile before their numbers are included in any SMS communications
  • Must give the app permission to your GPS location
  • Must give the app permission to your SMS on AUTO MODE
  • Must give the app permission to your push notification

User Account & Registration

To access most features of WakaSafe, you must create a user account. You agree to:

  • Provide accurate, current, and complete information during registration, including your full name and valid phone number
  • Keep your account credentials — including your journey PINs and Distress PINs— strictly confidential and secure
  • Notify Voddic immediately of any unauthorised access or suspected breach of your account
  • Be solely responsible for all activity that occurs under your account, whether or not authorised by you
  • Not share your account with any other person or use another person's account without authorisation
Important: Your journey PIN and distress PIN are critical security credentials. Voddic staff will never ask you for your PIN. Do not share your PINs with anyone — including family members — unless you fully understand the consequences.

Subscription & Payments

WakaSafe operates on a subscription-based model. Certain features, including the ability to start and track active journeys, require an active subscription.

5.1 Subscription Plans

Subscription plans, pricing, and durations are displayed within the application and may be updated by Voddic at any time. All prices are stated in Nigerian Naira (NGN) unless otherwise indicated.

5.2 Payment Processing

All subscription payments are processed securely through Paystack, a third-party payment service provider. By making a payment, you also agree to Paystack's terms and conditions. Voddic does not store your card details or payment information directly.

5.3 Refund Policy

  • Subscriptions are generally non-refundable once activated unless required by applicable Nigerian law
  • If a technical error on Voddic's part prevents you from accessing a paid feature, you may contact support for a credit or resolution within 7 days of the issue
  • No refunds will be issued for unused days of an active subscription upon voluntary cancellation

5.4 SMS Costs

Please note: WakaSafe sends SMS messages directly from your device using your SIM card. Standard SMS charges from your mobile network operator will apply and are your sole responsibility. WakaSafe is not responsible for any SMS charges incurred during the use of the application.

SMS & Location Services

WakaSafe's core functionality relies on your device's GPS and SMS capabilities. By using the application, you grant WakaSafe permission to:

  • Access your device's GPS and location services to obtain real-time coordinates during an active journey
  • Send SMS messages from your device's SIM card to phone numbers you have registered as emergency contacts
  • Continue accessing location and sending SMS in the background during an active journey session
  • Store location broadcast logs locally on your device for your journey history

6.1 Accuracy of Location Data

GPS accuracy depends on your device hardware, signal availability, and environmental conditions. Voddic makes no guarantee that location data transmitted via WakaSafe will be 100% precise. Location data is provided on an "as available" basis.

6.2 SMS Delivery

Delivery not guaranteed: SMS delivery depends entirely on your device's network connectivity, the recipient's network, and your carrier's infrastructure. Voddic cannot guarantee delivery of any SMS message sent through WakaSafe, including emergency SOS messages. Alternative means of communication during travel might be required where 2G Network is not strong.

6.3 Emergency Contact Consent

You are solely responsible for obtaining prior consent from every individual you add as an emergency contact. By adding a contact's phone number to WakaSafe, you confirm that the contact has consented to receive automated SMS location updates on your behalf.

PIN Security System

WakaSafe employs a 4-digits PIN security framework. Each PIN serves a distinct purpose:

  • Start PIN: A 4-digit PIN used to activate and begin a journey. Upon correct entry, a journey start SMS is sent to all emergency contacts.
  • End PIN: A 4-digit PIN used to safely conclude a journey. Upon correct entry, a "arrived safely" SMS with final location and journey duration is sent to all contacts.
  • Distress PIN: A separate 4-digit PIN that externally mimics an end journey action but internally triggers a silent SOS emergency alert to all registered contacts. This PIN is designed for use under duress or threat.
Critical Warning: The distress PIN is a life-safety feature. Deliberately misusing the distress PIN for non-emergency purposes, including testing, is strongly discouraged and may cause unnecessary alarm to your emergency contacts. Voddic accepts no liability for any harm, distress, or consequences arising from accidental or intentional misuse of the distress PIN.

You are solely responsible for setting, remembering, and safeguarding all your PINs. Voddic does not store your PINs in recoverable form. Lost PINs may require account-level intervention through customer support.

Emergency & SOS Features

WakaSafe provides an SOS Emergency button and a distress PIN as safety tools for travelers facing threatening situations. These features are intended to supplement — not replace — official emergency services.

WakaSafe is NOT a replacement for emergency services. In a life-threatening emergency, always contact the Nigerian Emergency Management Agency (NEMA), Nigeria Police Force (199), or other relevant emergency services first where possible. WakaSafe SOS alerts are sent to your personal emergency contacts only and do not connect to law enforcement or emergency responders.
  • Voddic does not monitor, intercept, or respond to SOS alerts triggered through the application
  • The effectiveness of an SOS alert depends entirely on whether your emergency contacts receive, read, and act on the SMS message in time
  • Voddic bears no liability for any outcomes — including injury, loss, or death — related to the activation or non-delivery of SOS alerts
  • The SOS Emergency button sends an immediate alert with your current GPS coordinates to all registered emergency contacts

User Responsibilities

As a user of WakaSafe, you agree to:

  • Use WakaSafe only for lawful purposes and in compliance with all applicable Nigerian laws and regulations
  • Ensure your device's GPS and SMS permissions are properly granted for the app to function correctly
  • Maintain an adequate SMS credit balance on your SIM card during active journeys
  • Keep the application updated to benefit from security patches and feature improvements
  • Not tamper with, reverse-engineer, decompile, or attempt to extract the source code of the application
  • Verify that all emergency contact numbers entered into the application are correct and belong to consenting individuals
  • Accept full responsibility for any consequences arising from incorrect configuration of journeys, contacts, or PINs

Prohibited Uses

You must not use WakaSafe to:

  • Stalk, harass, surveil, or track any individual without their full and informed consent
  • Send unsolicited or spam SMS messages to any phone number through the application's features
  • Provide false information about your identity, location, or journey to emergency contacts or Voddic
  • Deliberately trigger false SOS or distress alerts
  • Attempt to bypass subscription enforcement or payment systems
  • Use the application in any way that violates the Nigeria Communications Act, the Cybercrimes (Prohibition, Prevention, etc.) Act, or any other applicable law
  • Resell, sublicense, or commercially exploit the application or any part of its services without written consent from Voddic
  • Use the application to conduct or facilitate any criminal activity

Violation of these prohibitions may result in immediate account suspension, termination, and where warranted, reporting to law enforcement authorities.

Privacy & Data

Your privacy is important to us. WakaSafe collects and processes certain personal data necessary for the operation of the service, including your name, phone number, GPS coordinates during active journeys, and journey history logs.

  • Location data is only collected while a journey is active and you have granted location permissions
  • Journey data is stored locally on your device and may be synced with Voddic's backend servers depending on your subscription plan
  • Your emergency contacts' phone numbers are stored solely for the purpose of sending journey update SMS messages
  • Voddic does not sell, lease, or commercially share your personal data with third parties
  • Data may be shared with Paystack strictly for payment processing purposes

Disclaimer of Warranties

WakaSafe is provided on an "as is" and "as available" basis. To the fullest extent permitted by Nigerian law, Voddic expressly disclaims all warranties, whether express, implied, or statutory, including but not limited to:

  • Any warranty of merchantability, fitness for a particular purpose, or non-infringement
  • Any warranty that the application will be uninterrupted, error-free, or secure
  • Any warranty regarding the accuracy, completeness, or reliability of GPS location data
  • Any warranty that SMS messages sent through the application will be delivered to recipients
  • Any warranty that the application will function correctly on all devices or under all network conditions
Offline-first limitation: While WakaSafe is designed to operate without internet access, certain features may be impaired or unavailable in areas with no mobile network coverage at all. "Offline-first" refers specifically to the SMS-based location sharing which does not require internet data — it still requires a basic SMS-capable mobile signal.

Limitation of Liability

To the maximum extent permitted by applicable law, Voddic LTD, its directors, employees, agents, partners, and affiliates shall not be liable for any:

  • Indirect, incidental, special, consequential, or punitive damages arising from your use or inability to use WakaSafe
  • Loss of life, personal injury, or bodily harm resulting from reliance on WakaSafe's SOS or tracking features
  • Failed, delayed, or incorrect SMS delivery including emergency SOS alerts
  • Inaccurate GPS location data transmitted during a journey
  • Unauthorised access to your account or misuse of your PINs
  • Any losses resulting from third-party actions, including mobile network outages, device failures, or carrier-level SMS failures
  • Interruptions or discontinuation of the service

In any event, Voddic's total aggregate liability to you shall not exceed the total amount you paid for WakaSafe subscriptions in the three (3) months immediately preceding the event giving rise to the claim.

Indemnification

You agree to indemnify, defend, and hold harmless Voddic LTD and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your use or misuse of WakaSafe
  • Your violation of these Terms
  • Your violation of any rights of a third party, including privacy rights of emergency contacts
  • Any false or misleading information you provide in connection with the application
  • Any misuse of the SOS or distress PIN features

Termination

Voddic reserves the right to suspend or terminate your account and access to WakaSafe at any time, with or without notice, for reasons including but not limited to:

  • Breach of any provision of these Terms
  • Fraudulent, abusive, or illegal activity
  • Non-payment of subscription fees
  • Conduct that harms other users, Voddic, or third parties

Upon termination, your right to use WakaSafe ceases immediately. Any journey data stored locally on your device will remain accessible until you uninstall the application, but Voddic bears no obligation to retain or restore server-side data after account termination .

Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict of law provisions.

Any dispute, controversy, or claim arising out of or relating to these Terms or the use of WakaSafe shall first be attempted to be resolved through good-faith negotiation between the parties. If no resolution is reached within 30 days, the dispute shall be submitted to the jurisdiction of the courts of Ogun State, Nigeria.

Changes to These Terms

Voddic reserves the right to revise these Terms at any time. When changes are made, we will:

  • Update the "Last Updated" date at the top of this document and within the application
  • Notify registered users via an in-app notification or SMS alert for material changes
  • Provide a reasonable notice period before significant changes take effect

Your continued use of WakaSafe after the effective date of any revised Terms constitutes your acceptance of those changes. If you do not agree to the revised Terms, you must stop using the application and may request account deletion.
